Privacy Policy

This Privacy and Confidentiality Policy has been developed in accordance with the requirements of the Law of Ukraine "On Personal Data Protection" and other regulatory acts of Ukrainian legislation that govern legal relations related to the collection, processing, and storage of personal data, as well as citizens' rights to privacy and self-expression. It has also been designed to comply with European legislation, specifically the General Data Protection Regulation (GDPR; Regulation (EU) 2016/679).

1. DEFINITIONS

  • 1.1.In this Privacy and Confidentiality Policy, the following terms are used:
    • 1.1.1. “MAURI” – an individual entrepreneur, Tetiana Mykolaivna Kokhan, taxpayer identification number: 2392921103, who is the owner of the online store “MAURI” and engages in the sale of goods or services.
    • 1.1.2. “Website Administration of the online store ‘MAURI’ (hereinafter referred to as the ‘Website Administration’)” – authorized persons managing the website on behalf of the online store ‘MAURI,’ who organize the processing and collection of personal data, as well as determine the purposes of processing personal data, the categories of personal data to be processed and collected, and the actions or operations performed with the personal data.
    • 1.1.3. “Online store ‘MAURI’” – an online platform on the Internet, located at the following link: http://www.mauri-cosmetics.com/, where the User can purchase goods or services from ‘MAURI.
    • 1.1.4. “Personal data” – any information relating directly or indirectly to a specific or identifiable individual (data subject), including the User of the website.
    • 1.1.5. “Processing of personal data” – any action (operation) or set of actions (operations) performed with or without the use of automation tools on personal data, including: collection, recording, systematization, accumulation, storage, clarification (updating, modification), extraction, use, transfer (distribution, provision, access), anonymization, blocking, deletion, and destruction of the User’s personal data.
    • 1.1.6. “Confidentiality of personal data” – a mandatory requirement to prevent the dissemination of the personal data of the subject (User) without the individual’s personal consent or another legal basis, which is adhered to by the Website Administration or other persons who have access to personal data.
    • 1.1.7. “User of the online store ‘MAURI’ or ‘User’” – an individual who can be identified directly or indirectly, including by an identifier such as a name, identification number, location data, online identifier, or by one or more factors specific to the physical, physiological, genetic, mental, economic, cultural, or social identity of that individual (Art. 4, GDPR). A User also includes any person who purchases goods or services from ‘MAURI’ or simply visits the online store ‘MAURI.
    • 1.1.8. “Cookie” – a small piece of data sent by a web server and stored on the user's computer, which the web client or web browser sends back to the web server in an HTTP request each time it attempts to open a page of the relevant website.
    • 1.1.9. “IP address” – a unique network address of a node in a computer network built on the IP protocol.

2. "SUBJECT OF THE PRIVACY AND CONFIDENTIALITY POLICY"

  • 2.1. By using the website or purchasing a product or service offered in the online store ‘MAURI,’ the User confirms their consent to ‘MAURI’ and the Website Administration, as well as their authorized representatives, for the collection and processing of personal data.
  • 2.2. The User grants their consent to the Website Administration and ‘MAURI’ for the processing of the information received, including collection, systematization, accumulation, storage, clarification (updating, correction), use, distribution, anonymization, blocking, and destruction of the personal data specified in the questionnaire, for the purposes of forming a database of participants, compiling statistical reports, conducting marketing research, and interacting with the User, including through telecommunications networks, such as sending SMS messages and emails, until such consent is revoked.
  • 2.3. The User confirms their consent that the Website Administration and ‘MAURI’ have the right to interact with the User through direct contacts using various means of communication, including but not limited to: postal mail, email, the Internet, etc.
  • 2.4. The personal data permitted for processing and collection under this Privacy and Confidentiality Policy includes, but is not limited to, the following information:
    • 2.4.1. Customer data (individual User):
    • - First name and/or last name;
    • - Email address;
    • - Phone number;
    • - Company name;
    • - Organization number and address;
    • - Delivery address;
    • - Links to the individual’s social media profiles;
    • - IP address.
    • 2.4.2. Transaction data:
    • - Payment information from the individual (User) and other information about the services or goods ordered from the online store ‘MAURI.’
    • 2.4.3. Financial data:
    • - Information about bank accounts and credit or debit cards, billing information, and payment methods.
    • 2.4.4. Contact details:
      • - information or records created as a result of contact with ‘MAURI’ or the Website Administration. For example, this may include phone calls, online contacts, communication via email, physical mail, or messengers such as Viber, Telegram, WhatsApp, and others.
      • 2.4.5. Technical data:
      • - IP address, date and time of the request, content of the request, access status/HTTP status code, the website sending the request, browser, operating system and its interface, language and version of the browser software.
      • 2.5. During any communication between the User and ‘MAURI,’ the Website Administration has the right to record the conversation with the User or store any data about the communication between the User and ‘MAURI’ for the purpose of improving service quality.

3. COOKIE POLICY

  • 3.1. ‘MAURI’ and the Website Administration collect information about the User's visits to the online store ‘MAURI’ for the purpose of obtaining visitor statistics and evaluating their usage effectiveness, forming a personalized approach, and adapting to the interests of each User. The Website Administration and ‘MAURI’ do this using various technologies, one of which is cookies. These are data that a website can send to the browser, which will be stored on the computer for future identification by the website.
  • 3.2. Cookies are used to assess the effectiveness of websites (for example, to measure the number of visitors and the duration of their stay on the online store ‘MAURI’), to identify the most interesting and frequently visited topics and pages, and to ensure convenient navigation and usage of the aforementioned website without collecting any personal information. Cookies can also be used to create a personalized approach based on the existing interaction experience of the User or any other individual with the online store ‘MAURI’ and their preferences. Over time, this information allows for improving the overall experience.
  • 3.3. Cookies are text files that are sent by the online store ‘MAURI’ to the User’s device, allowing for the improvement of the ‘MAURI’ website. Cookies are unique to the User's account or browser.
  • 3.4. The User will be informed about the use of cookies during their first visit to the online store ‘MAURI’ website. If the User is opposed to the collection of information through cookies, they can adjust their preferences at any time through the Cookie Settings Center.
  • 3.5. Browsers provide Users with the ability to manage cookies according to their requirements. The User can manage and/or delete, restrict, or block cookies from the website at any time by modifying the browser settings. If the User does not wish to use cookies on the online store ‘MAURI’ website, they should first disable cookies in their browser.
  • 3.6. Through their browser settings, the User can choose which cookies to accept and which to reject. These settings depend directly on the browser being used by the User:
  • - Cookie settings in Chrome;
  • - Cookie settings in Firefox;
  • - Cookie settings in Internet Explorer;
  • - Cookie settings in Safari.
  • If the User decides to block certain functional cookies, some services of ‘MAURI’ may become unavailable to them. In addition to the settings available on the online store ‘MAURI’ website, the User can opt out of using specific cookies.

4. "COLLECTION AND USE OF PERSONAL DATA"

  • 4.1. ‘MAURI’ and the Website Administration collect personal data in the following cases:
  •      - When the User visits the online store ‘MAURI’ website;
  •      - When the User fills out contact forms on the online store ‘MAURI’ website;
  •      - When the User subscribes to newsletters available on the online store ‘MAURI’ website;
  •      - When the User contacts ‘MAURI’ or the Website Administration by phone, including through messengers, email, chat on the website, or social media;
  •      - ‘MAURI’ and the Website Administration may obtain personal data from individuals when the User clicks buttons on social media such as “Like,” “Subscribe,” or interacts in other ways with ‘MAURI’s official pages on Facebook, LinkedIn, Instagram, and other platforms.

5. PURPOSE OF COLLECTING AND PROCESSING PERSONAL DATA

  • 5.1. The personal information of the User is used by the online store ‘MAURI’ and the Website Administration for the following purposes:
    • 5.1.1. Contractual purpose:
      • - To enter into a contract, including contractual information about the individual, namely: first name and last name, phone number, email address, and delivery address;
      • - To conclude, execute, manage, and ensure compliance with services or sell products, including any related contracts, additional documents such as appendices, amendments, etc.;
      • - To share personal data with partners to provide services or sell goods to the individual;
      • - To manage payments or fees and charges;
      • - To inform the User about changes/additions to all services or products provided or sold through the online store ‘MAURI,’ as well as the Privacy and Confidentiality Policy and cookie policy;
      • - When ‘MAURI’ and the Website Administration send the ordered goods to the User, whether delivered by their own means or through a logistics (postal) company;
      • - To notify the User of the estimated time for service provision or delivery of goods.
    • 5.1.2. Legal purpose:
      • - For statistics, analysis, and market research;
      • - To analyze and improve ‘MAURI’ products and services;
      • - To send goods to the User via postal services (logistics companies);
      • - To provide the User's personal data to authorized state bodies in accordance with the law;
      • - To support ‘MAURI’ business processes;
      • - To monitor, verify, and record communication between the User and ‘MAURI’;
      • - From time to time, to send the User promotional information, useful content, newsletters, and updates on new offers and the operating hours of ‘MAURI’ stores.
      • - To inform the User about the results of complaint reviews (if applicable);
      • - To notify about the contact person at ‘MAURI’ who will communicate with the User;
      • - For the purpose of offering the User participation in various promotions, programs, loyalty systems, etc., organized by ‘MAURI’;
      • - To enable ‘MAURI’ to conduct various promotions, programs, loyalty systems, etc., including registering the User in its database of participants in such promotions, programs, loyalty systems, etc.;
      • - For the purpose of informing Users about the procedures for promotions, programs, loyalty systems, etc., organized by ‘MAURI,’ as well as notifying them about changes to the policies, rules, regulations, and instructions governing these promotions, programs, loyalty systems, etc.;
      • - To comply with other legal obligations.

6. USER RIGHTS

  • 6.1.The User, in relation to their personal data provided for collection, accumulation, processing, storage, and use by ‘MAURI’ and the Website Administration based on the Law of Ukraine on Personal Data Protection and the General Data Protection Regulation (GDPR; Regulation (EU) 2016/679), has the following rights:
    • - To know the sources of collection, the location of their personal data, the purpose of processing, and the storage location;
    • - To receive information about the conditions for accessing personal data;
    • - To access their personal data;
    • - To obtain information regarding whether their personal data is being processed;
    • - To make a reasoned request to ‘MAURI’ to object to the processing of their personal data;
    • - To submit a reasoned request for the correction or destruction of their personal data if such data is being processed unlawfully or is inaccurate;
    • - To protect their personal data from unlawful processing and accidental loss, destruction, or damage due to intentional concealment, non-provision, or untimely provision, as well as to protect against the provision of false information that could harm their honor, dignity, or business reputation;
    • - To file complaints regarding the processing of their personal data with competent authorities or in court;
    • - To seek legal remedies in the event of violations of personal data protection legislation;
    • - To make reservations regarding limitations on the right to process their personal data when providing consent;
    • - To withdraw consent for the processing of personal data.
    • - To know the mechanism of automatic processing of personal data;
    • - The right to amend incomplete or inaccurate personal data;
    • - The right to delete personal data if the individual has successfully exercised the right to object to the processing of their data;
    • - The right to withdraw consent for the processing of personal data at any time;
    • - The right to object to the use or processing of personal data by ‘MAURI’ and the Website Administration if the individual believes it affects their rights and freedoms.
  • 6.2. To exercise the above rights, the User should contact ‘MAURI’ at the email address: mauri.cosmetics@gmail.com. If ‘MAURI’ receives a request from the User to exercise any of the aforementioned rights, ‘MAURI’ may ask the User to verify their identity before acting on the request. This is necessary to ensure the protection and security of personal data.

7. TRANSFER AND DISCLOSURE OF PERSONAL DATA OF THE INDIVIDUAL

  • 7.1. ‘MAURI’ and the Website Administration do not transfer or disclose any personal data about the User without their consent, except for the purposes mentioned in this Privacy Policy, or if required by law.
  • 7.2. ‘MAURI’ and the Website Administration may use third-party services to provide and sell goods to the User. All processors acting on behalf of ‘MAURI’ process the User's data solely in accordance with ‘MAURI’s instructions and strictly adhere to this Privacy Policy, as well as the laws of Ukraine and the European Union.
  • 7.3. ‘MAURI’ and the Website Administration may transfer the User's personal data outside of the European Union and Ukraine in accordance with the obligations of this Privacy Policy and the laws, in the following cases:
    • - The country to which the personal data is being transferred has been recognized by Ukraine and the European Commission or another authorized body as providing an adequate level of protection for personal data;
    • - The service provider/vendor of goods, in accordance with this Privacy Policy, is bound by relevant and specific contractual obligations required by applicable data protection legislation.

8. MEASURES TO PROTECT USER PERSONAL DATA

  • 8.1. "MAURI" and the Website Administration take measures to ensure the protection and security of User personal data at all stages of processing, including through organizational and technical measures.
  • 8.2. "MAURI" and the Website Administration take all necessary actions to prevent accidental loss, misuse, unauthorized access, alteration, or disclosure of User personal data.
  • 8.3. "MAURI" and the Website Administration have implemented a process to address personal data security breaches or incidents and will inform the User and any relevant regulator of any suspected breach or incident if "MAURI" or the Website Administration is required to do so by law.
  • 8.4. If "MAURI" or the Website Administration transfers User personal data, "MAURI" will require third parties to take measures to protect that personal data. "MAURI" and the Website Administration do not grant any rights to third parties to use personal data for their own purposes. Third parties may use User personal data for specific purposes and in accordance with "MAURI's" instructions.

9. ADDITIONAL INFORMATION ABOUT THE USER'S PERSONAL DATA

  • 9.1. "MAURI" and the Site Administration are not obligated to provide the User's personal data to third parties.  
  • 9.2. "MAURI" and the Site Administration retain personal data only as long as necessary. In retaining personal data, "MAURI" and the Site Administration consider the following:
    • - the duration of the purposes for which "MAURI" and the Site Administration collect personal data, and the duration for which "MAURI" and the Site Administration are obligated to provide services or sell products;  
    • - ensuring and managing the relationship between "MAURI," the Site Administration, and the User;  
    • - "MAURI" and the Site Administration also retain the User's personal data to fulfill regulatory requirements, accounting, reporting, and legal obligations or directives.
  • 9.3. Processing is lawful only if the data subject (User) has given consent to the processing of their personal data for one or more specific purposes. The processing of a child's personal data is lawful if the child is at least 16 years old. If the child is not yet 16, such processing is lawful only if consent is given by the parents or permitted by the person holding parental responsibility for the child.
  • 9.4. The "MAURI" online store may contain links to other websites. However, if the User uses these links, they should be aware that "MAURI" and the Site Administration do not control these websites. Therefore, "MAURI" and the Site Administration are not responsible for the protection and confidentiality of any information that the User provides while visiting such sites, and such sites are not governed by this Privacy and Confidentiality Policy. The User should exercise caution and familiarize themselves with the policy applicable to the relevant website.

ADDITIONAL TERMS

  • 10.1. "MAURI" reserves the right to make changes to the Privacy and Confidentiality Policy without the User's consent, notifying them 30 (thirty) calendar days prior to the changes taking effect. Changes to the Privacy and Confidentiality Policy are made by posting the new, updated version at the following link: [link]. This link will always provide access to the current and valid version of the Privacy and Confidentiality Policy.
  • 10.2. The new Privacy and Confidentiality Policy takes effect upon its posting on the "MAURI" online store website, unless otherwise specified in the new version of the Policy.
  • 10.3. In the event of changes that significantly affect the User's privacy rights, "MAURI" or the website Administration will send an additional notification via email to the User. If the User does not agree with the changes to this Privacy and Confidentiality Policy, they should contact "MAURI" at the email address: mauri.cooperation@gmail.com.
  • 10.4. If the User disagrees with any changes made to the Privacy and Confidentiality Policy, they must cease using the "MAURI" online store and have the right to request that the website Administration and "MAURI" delete their personal data. If "MAURI" or the website Administration does not receive a refusal from the User regarding the new version of the Privacy and Confidentiality Policy, it will be deemed that the User has agreed to the new version of the Policy.
  • 10.5. Users (for citizens of the European Union) may file a complaint regarding violations by "MAURI" or the website Administration of the General Data Protection Regulation (GDPR; Regulation (EU) 2016/679) with the court or the European Data Protection Supervisor.   • 10.6. Users (for citizens of any countries other than those mentioned in paragraph 10.5 of this Privacy and Confidentiality Policy) may file a complaint regarding violations by "MAURI" or the website Administration of legislation governing the protection of personal data with the court or the Commissioner of the Verkhovna Rada of Ukraine for Human Rights in the field of personal data protection.
